Hello and welcome to today's webinar hosted by me, Joe Boyhan of MCO, and Paul Murdock of MCG Compliance Services. Today, we're going to be looking at the Foreign Corrupt Practices Act or the FCPA.
I now want to pass you on to Paul, who's going to start today's webinar.
So, practical application to your employees. So, you know, if you think about it, when an employee is about to meet with a foreign official, especially if it's the first time, you want to make sure that the employee is fully aware of what they can and cannot do. You know, what gifts they can give to a foreign official, if any. We want to make sure that they're cognizant with all of that. So, you want to make sure that you have a conversation, that the employee will have a conversation with compliance and legal. That will be a part of, hopefully a part of the training that we talked about before, so that they recognize when these conversation should be had.
Gifts and entertainment policy, this is clearly an area where you should make sure that there's discussion of FCPA, especially for you guys that are out there dealing with foreign government officials, flying back and forth to foreign countries. It's important that you have a gift and entertainment policy and it's properly papered as you'd like to say. You know, we have a clarity so that there's no real ambiguity. |
Next slide, Joe. Okay. So, from an FCPA compliance program perspective, some of our greatest strengths is awareness, training, field practices. Once again in terms of what people are actually doing out there and conversations and you're having with your folks before they go out there. Monitoring, reporting and you know, other things that you could think of that would possibly enhance that. |
Alright, next slide Joe. All these things can also be our greatest exposure. So, you know, once again, we want to make sure that we're aware so that we don't create blind spots, so to speak, with respect to these, right? So, you know, it's a double sided coin and we should be aware of that. |
